1. Agreement to these terms
These Terms and Conditions (“Terms”) govern your access to and use of the websites learn.desqcon.com and desqcon.com (together, the “Sites”), and the training courses, learning materials, and related services offered through them (the “Services”). The Services are provided by Desqcon (“Desqcon”, “we”, “us”, or “our”).
By creating an account, placing an order, enrolling in a course, or otherwise using the Sites, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Sites or the Services.
2. Eligibility and accounts
You must be at least 18 years old, or the age of majority in your jurisdiction, to purchase a course. If you enroll on behalf of an organization, you confirm that you have authority to bind that organization to these Terms.
To buy or access a course you need an account. You agree to provide accurate and current registration details, to keep your password confidential, and to tell us promptly if you suspect unauthorized use of your account. You are responsible for all activity that takes place under your account. Accounts are personal and may not be shared, sold, or transferred.
3. Courses and learning materials
Course descriptions, durations, lesson counts, and outcomes shown on the Sites are provided in good faith and may be updated as content is improved. We may add, change, or retire lessons, quizzes, and resources at any time, provided that we do not materially reduce the content of a course you have already purchased during your access period.
Our courses are educational. Completing a course does not guarantee a certification, an exam result, employment, or any particular career outcome. Desqcon is an independent training provider. References to ITIL, ITSM, ServiceNow, and other frameworks or products are for descriptive purposes only, and all related trademarks belong to their respective owners. Unless a course page states otherwise, our courses are not affiliated with, endorsed by, or sponsored by those owners.
4. Pricing and payment
Prices are shown on each course page, in US dollars unless stated otherwise, and may change without notice. The price that applies to you is the one displayed at the time you place your order. Prices may exclude taxes, duties, or bank and payment processing charges that apply in your location.
Payments are processed by third-party providers, currently PayPal and Razorpay. We do not store your full card details on our servers. Your use of a payment provider is subject to that provider’s own terms and privacy policy. Your currency, exchange rate, and any conversion fee are determined by your payment provider and your bank. If a payment fails or is reversed, we may suspend access to the related course until the payment is resolved.
Access to a course is granted once your payment has been confirmed. If you completed payment and do not see the course in your account, please contact us so we can resolve it quickly.
5. Access and license
When you purchase a course, we grant you a personal, non-exclusive, non-transferable, revocable license to access and view that course for your own learning, for the access period stated on the course page or, if none is stated, for as long as the course remains available on the Sites.
All course content, including videos, slides, documents, templates, quizzes, text, graphics, logos, and software, is owned by Desqcon or its licensors and is protected by copyright and other intellectual property laws. Except as these Terms permit, you may not copy, record, download, redistribute, resell, publicly display, translate, or create derivative works from any course content, and you may not share your login so that others can access it.
6. Refunds and cancellations
We want you to be satisfied with your learning. If a course does not meet the description on its page, or you experience a technical problem that we are unable to resolve, you may request a refund within 7 days of purchase, provided that you have completed no more than 20 percent of the course content.
To request a refund, contact us using the details below and include your order number and the email address on your account. Approved refunds are returned to the original payment method, and processing times depend on your payment provider and bank. Fees charged by a payment provider or bank may not be recoverable. Refunds are not available where an account has been suspended for a breach of these Terms, or for courses where you have completed more than 20 percent of the content or downloaded the course materials.
Instructor-led, private, or custom corporate training and consulting engagements are governed by the written proposal or statement of work agreed with you, which takes priority over this section.
7. Acceptable use
You agree to use the Sites lawfully and respectfully. You must not: share, sell, or publish course content or your account access; use bots, scrapers, or automated tools to copy content or overload the Sites; attempt to gain unauthorized access to any account, system, or network; upload malicious code or unlawful, defamatory, or infringing material; interfere with other learners’ use of the Sites; or use the Services to provide a competing training product.
We may suspend or terminate your account, without refund where the breach is serious, if you violate these Terms or misuse the Services.
8. Learner contributions
If you post comments, questions, reviews, or other material on the Sites, you remain the owner of that material. You grant Desqcon a non-exclusive, worldwide, royalty-free license to host, display, and use it in connection with operating and promoting the Services. You are responsible for what you post and must not post anything you do not have the right to share.
9. Privacy and data protection
We collect and use personal information as described in our Privacy Policy. This includes account details, order and payment confirmation data, and learning progress. We use this information to deliver the Services, process orders, provide support, improve our courses, and communicate with you. We do not sell your personal information. Please read the Privacy Policy for details about your rights and choices.
10. Third-party services and links
The Sites may use or link to third-party services, including payment processors, sign-in providers such as Google, video hosting, analytics, and external websites. We do not control these services and are not responsible for their content, availability, or practices. Your use of them is at your own risk and subject to their own terms.
11. Availability and changes to the Services
We aim to keep the Sites available and accurate, but we do not guarantee uninterrupted or error-free operation. We may perform maintenance, change features, or suspend the Services for technical, security, or legal reasons. We may also update these Terms from time to time. When we make material changes, we will update the “Last updated” date below, and your continued use of the Sites after the change means you accept the revised Terms.
12. Disclaimer of warranties
To the fullest extent permitted by law, the Sites and the Services are provided “as is” and “as available”. Desqcon makes no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. Course content reflects general guidance and the experience of our instructors. It is not legal, financial, or professional advice for your specific situation, and you should apply your own judgment when putting it into practice.
13. Limitation of liability
To the fullest extent permitted by law, Desqcon and its directors, employees, instructors, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill, arising from your use of, or inability to use, the Sites or the Services.
Our total liability to you for any claim arising out of or relating to these Terms or the Services will not exceed the amount you paid to us for the course or service that gave rise to the claim. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
14. Indemnity
You agree to indemnify and hold harmless Desqcon and its personnel from claims, losses, and expenses, including reasonable legal fees, arising from your breach of these Terms, your misuse of the Services, or your violation of any law or third-party right.
15. Governing law and disputes
These Terms are governed by the laws of India, without regard to conflict of law principles. We encourage you to contact us first so that we can try to resolve any concern informally. If a dispute cannot be resolved informally, it will be subject to the exclusive jurisdiction of the competent courts in India, except where mandatory consumer protection laws in your country of residence give you the right to bring a claim elsewhere.
16. General
If any part of these Terms is found to be unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our written consent, and we may assign them in connection with a merger, acquisition, or sale of our business. These Terms, together with the Privacy Policy and any course-specific terms shown at purchase, are the entire agreement between you and Desqcon regarding the Services.
17. Contact us
For questions about these Terms, orders, access problems, or refund requests, please reach us through the contact form on desqcon.com or by using the “Talk to Us” chat on the Sites. Please include your account email address and order number so we can help you faster.
